PROPOSED RATE CHANGES TO RESIDENTIAL & COMMERCIAL SOLID WASTE AND RECYCLING RATES

NOTICE IS HEREBY GIVEN that the City Council of the City of Glendora (City) will hold a public hearing to consider proposed changes to the rates charged for residential and commercial refuse collection services and disposal fees within the City. Said public hearing will be held at a regular meeting of the Glendora City Council as follows:

WHY YOU ARE RECEIVING THIS NOTICE

You are receiving this notice because you are a property owner or customer of solid waste collection services in the City of Glendora. The solid waste disposal services in the City are performed by Arakelian Enterprises, Inc., dba Athens Services (“Athens Services”) through a Franchise Agreement between the City and Athens Services.

This notice is provided in accordance with Proposition 218 (Article XIII D of the California Constitution), which requires written notice and a public hearing before adjusting property-related service rates. If approved by the City Council, the proposed rates are anticipated to take effect on July 15, 2026.

The public hearing will include the consideration of a resolution to authorize maximum rates for solid waste collection and recycling services for a five-year (5-year) period commencing July 15, 2026, through July 14, 2031.

WHY RATES ARE BEING ADJUSTED

The proposed rate adjustments reflect additional services provided by Athens Services under the Franchise Agreement, including, without limitation, increased costs associated with State-mandated organics diversion programs, known as Senate Bill 1383 (SB 1383).  

SB 1383 requires waste haulers and jurisdictions to implement programs that reduce contamination, expand recycling and organics collection services, conduct public education and outreach, track and report program participation, and support enforcement of State recycling requirements.

The proposed rate adjustments reflect updates to the Franchise Agreement and are necessary to fund the full cost of providing required solid waste and recycling services, including labor, equipment, materials, operational expenses, and compliance with State regulations.

WHAT IS CHANGING

  • Standardization of a three-container collection system for commercial and multi-family customers (trash, recycling, and organics) to comply with State requirements under SB 1383.

  • Proposed adjustments to solid waste service rates, including annual inflation-based increases.

  • The proposed maximum rates represent the rates that may be charged to customers if a majority protest is not received. The proposed rates would be effective for a five-year period beginning July 15, 2026, through July 14, 2031.

PROPOSED RATE STRUCTURE

  • Beginning July 15, 2026, and on each July 1 thereafter through, and including, July 1, 2030, the maximum rates may be adjusted annually based on the Consumer Price Index for Trash and Garbage Collection (CUUR0000SEHG02), U.S. City Average, for the prior 12-month period (March to March), plus one percent (the “Trash CPI Adjustment”).

  • Beginning July 15, 2026, and on each July 1 thereafter through, and including, July 1, 2030, Athens Services shall add a supplemental fee of $23.05 annually to the then-existing net rates applicable to Commercial business and multi-family generators.

WHAT THIS MEANS FOR YOU

Residential

  • Residential rates under the Franchise Agreement will remain consistent with the July 1, 2026 annual rate adjustment. The next residential rate adjustment would not occur until July 1, 2027.

  • No changes to the current three-container collection system (trash, recycling, and organics), which is already in place.

  • Rates will continue to be adjusted annually based on inflation (Consumer Price Index for trash services) plus one percent, in accordance with the City’s Franchise Agreement with Athens Services.

Commercial and Multi-Family

  • Commercial and multi-family properties will be required to use a three-container collection system (trash, recycling, and organics) in compliance with SB 1383.

  • Rates will continue to be adjusted annually based on inflation (Consumer Price Index for trash services) plus one percent.

  • Beginning July 15, 2026, and on each July 1 thereafter through, and including, July 1, 2030, Athens Services shall add a supplemental fee of $23.05 annually to the then-existing net rates applicable to Commercial business generators. This supplemental fee is in addition to any other applicable rate adjustments, including the annual Trash CPI Adjustment.

YOUR RIGHT TO PROTEST
Property owners and customers who are directly responsible for payment of the service may submit a written protest to oppose the proposed rates.

  • Only one protest per parcel address will be counted.

  • Written protests must be received by the City Clerk (not postmarked) prior to the close of the public hearing on July 14, 2026.

  • If you do not wish to protest the proposed rates, no action is required.

HOW TO SUBMIT A WRITTEN PROTEST
Written protests may be submitted either by mail or in person. Email and fax submissions will not be accepted.

Written protests may be submitted to the City Clerk prior to or during the public hearing on July 14, 2026, before the close of the hearing.

A valid written protest must include:

  • Name and signature of the property owner or customer responsible for account payment

  • Property address or Assessor’s Parcel Number (APN)

  • A clear statement opposing the proposed rates

WHAT HAPPENS AFTER THE PUBLIC HEARING

At the conclusion of the public hearing:

  • If written protests are submitted for the majority of the affected parcels, the proposed rates cannot be adopted.

  • If less than a majority of written protests are received, the City Council may approve the proposed rates.

Further information on this item will be posted to the city’s website at CityofGlendora.gov/citymeetings and will be on file for public inspection and copying for the cost of duplication, at the office of the City Clerk, 116 E. Foothill Blvd, Glendora, CA, between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, exclusive of holidays, and will be available for agenda posting and public inspection as required by the Ralph M. Brown Act, California Government Code 54950 et seq. as applicable.

The City has determined that the proposed action is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15273, because the proposed rate adjustments are for the purpose of meeting operating expenses and costs associated with providing solid waste collection and recycling services. Separately, the action is exempt under CEQA Guidelines section 15061(b)(3), as it can be seen with certainty that the proposed rate adjustments will not have a significant effect on the environment.

If you challenge this action in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City Council at, or prior to, the public hearing.
